The High Court in Accra has dismissed an application filed by Akua Afriyie Owusu, the New Patriotic Party (NPP) parliamentary candidate for Ablekuma North, seeking a 10-day interim injunction to halt a rerun of elections in 19 polling stations within the constituency.
Presiding Judge Justice Ali Baba Abature ruled that the ex-parte application was “unmeritorious” and did not meet the legal threshold for granting such an injunction.
Lawyers for Owusu, led by the NPP’s Director of Legal Affairs, Garry Nimako Marfo, had argued that proceeding with the Electoral Commission’s directive would cause irreparable harm to their client. However, the court disagreed and dismissed the application.
The injunction sought to restrain the Electoral Commission and interested parties including Awurabena Aubyn and the National Democratic Congress (NDC) from conducting the rerun.
The ruling clears the way for the Electoral Commission to move forward with its planned rerun in the affected polling stations.
