Enchi District Court in the Western North Region has made a dramatic reversal, overturning its earlier decision to release mining equipment seized from illegal miners in the Boin Forest Reserve.
The court presided over by His Worship Lawrence Buenor Buer, declared its initial ruling “wrong in law” and acknowledged that it lacked jurisdiction to handle cases related to illegal mining, also known as “galamsey”.
The case involves six defendants, with four absent and two declared at large.
The court’s earlier decision on March 28, 2025, to release two Liugong excavators and other mining equipment, was deemed erroneous.
Upon reviewing the facts and applicable mining laws, the court nullified its previous order.
In a fresh directive, the court ordered the retrieval of the excavators and equipment, which will be handed over to the Enchi Forestry Commission for safekeeping.
The police and Forestry Commission have been tasked with ensuring compliance with the new orders.
Citing legal precedents, the court emphasized its authority to correct its errors and uphold justice.
This reversal highlights the court’s commitment to maintaining the integrity of the judicial process.
